Austin, Texas — Right On Crime, a national campaign of the Texas Public Policy Foundation, released its latest research paper, Accountability, Transparency, and Public Safety: A Conservative Approach to Bail Bond Oversight, outlining how Texas can strengthen public safety while supporting a more effective bail bond industry through consistent statewide oversight.
The paper examines how the state’s fragmented county-by-county regulatory system has produced inconsistent enforcement, uneven oversight, and limited transparency, creating an uneven playing field for responsible bail bond professionals and making it more difficult to identify and address bad actors.
“When oversight is inconsistent and bond forfeitures are rarely enforced, the system creates incentives that undermine public safety instead of protecting it,” said Brett Tolman, Executive Director of Right On Crime. “Texas has an opportunity to modernize its approach by ensuring that those who profit from the bail system are held to the same standards of responsibility and transparency expected throughout our justice system.”
Under current Texas law, counties with populations above 110,000 establish their own Bail Bond Boards, resulting in a patchwork of regulations that varies widely across the state. This new research argues that this decentralized structure creates inconsistent standards for bail bond professionals, limits the state’s ability to collect meaningful data on bond forfeitures, failures to appear, and reoffending, and makes it more difficult to ensure consistent oversight across county lines. By contrast, most states utilize a centralized regulatory framework that promotes uniform standards, stronger consumer protections, more effective enforcement, and greater transparency—benefiting both the public and reputable members of the industry.
The paper recommends transferring bail bond regulation to the Texas Department of Insurance, which already oversees financial and insurance-related industries and possesses the expertise to regulate surety businesses operating statewide. A centralized oversight framework would establish consistent standards across Texas, improve data collection, strengthen enforcement of existing laws, and increase public confidence in the bail system. It would also help ensure responsible bail bond professionals are operating within a fair, transparent, and professionally regulated marketplace while preserving access to commercial bail for eligible defendants.
